EO 1 - Creating the Financial Management Team

EXECUTIVE ORDER NO. 1
Series of 2010
AN EXECUTIVE ORDER CREATING THE FINANCIAL MANAGENT TEAM FOR THE CITY'S ECONOMIC ENTERPRISES, ITS TECHNICAL WORKING GROUP (TWG) AND SECRETARIAT

 

WHEREAS, Republic Act No. 7160 otherwise known as the Local Government Code of 1991, Section 17 (Basic Services and Facilities) states that "Local Government Units shall endeavor to be self-reliant and shall continue exercising the powers and discharging the duties and functions currently vested upon them. Among other things, such basic services and facilities include the operation of public markets, slaughterhouses and other city enterprises.

WHEREAS, the operation of Public Economic Enterprises (PEE's) such as public markets, slaughterhouses, including the City Dredger Machine and the other heavy equipment owned by the City Government of Cotabato are vital components of local government unit in generating revenues and provide quality services and facilities for the welfare of its constituents and help spur economic development .

WHEREAS, the Sangguniang Panlungsod Ordinance No. 465, otherwise known as the Market Code, as amended, mandates that the City Government of Cotabato to operate and administer local public markets and other related structures and equipment;

WHEREAS, for all intents and purposes, the City Government of Cotabato operates Public Economic Enterprises, the Mega Market, the City Slaughterhouse, the City Central Arcade, newly constructed City Mega Square including the Operation of the City Dredging Machine and other Heavy Equipment owned by LGU.

WHEREAS, the City Government of Cotabato, in its desire to improve the management of its PEE's to increase its revenue generating capacity and provide better, more efficient and effective delivery of basic services;

WHEREAS, among other things, the creation of the Financial Management Team seeks to institutionalize local structure and customize capacity building interventions within the purview and priority of the local government unit with the sole objective of managing effectively a purposeful PEE's to improve the service delivery mechanisms and revenue-generating capacity through sound management practices;

NOW, THEREFORE, I, JAPAL J. GUIANI, JR., Mayor of the City of Cotabato, by virtue of the powers vested in me by law, do hereby create the Financial Management Team for the City's Economic Enterprise:

Section 1. Composition of the Financial Management Team

Chairman -        City Treasurer
Vice Chairman - City Administrator

City Planning and Development Coordinator

City Councilor (Chairman, SP Committee on Finance)

Section 2. Composition of the Technical Working Group and Secretariat

Technical Working Group

1. Assistant City Budget Officer

2. Assistant City General Services Officer

3. Assistant City Planning and Development Coordinator

Secretariat

a. Representative, City Treasury Office

b. Representative, City Budget Office

c. Representative, Office of the Sangguniang Panlungsod

Section 3. Duties and Responsibilities of FMT

The FMT shall exercise the following:

a. Determine the income reasonably projected as collectible for the ensuing fiscal year;

b. Recommend appropriate tax and other revenue measures or borrowings which may be required to support budget;

c. Recommend for the City Mayor level of annual expenditures and ceilings of spending for economic, social and general services based on the approved local development plans;

d. Recommend to the City Mayor the City proper allocation of expenditures for each development activity between current operating expenditures and capital outlays;

e. Recommend to the City Mayor the amount to be allocated for capital outlay under each development activity or infrastructure project;

f. Assist the Sangguniang Panlungsod in the review and evaluation of budgets of the city and recommend the appropriate action thereon;

g. Assist the Sangguniang Panlungsod members concerned in the analysis and review of annual regular and supplement budgets of the City to determine compliance with statutory and administrative requirements; and

h. Conduct semi-annually, annual review and general examination of cost and accomplishments against performance standards applied in understanding development projects.

Section 4. Duties and Responsibilities of the TWG

The TWG shall be responsible be responsible to:

a. Provide technical assistance to the FMT during meetings;

b. Provide technical assistance to the FMT when there are issues or concerns to be resolved;

c. Conduct research study on financial and technical matters referred to the committee for consideration;

d. Perform such other related tasks as requested by the FMT.

Section 5. Duties and Responsibilities of the Secretariat

The Secretariat shall be responsible to:

a. Take the minutes of all the minutes of the meetings of the FMT and produce necessary documents;

b. Keep a record of all the minutes of the meetings conducted by LFC and furnish the same the concerned parties/agencies as may be deemed necessary;

c. Perform such other functions as may be required by the FMT;

d. Facilitate invitations to all concerned parties to the conference prior to the schedule;

e. Reproduce documents and distribute the same to all concerned, as may be required by the FMT;

f. To take custody of all documents submitted to the FMT ensuring that they are intact and free from any tampering or unauthorized disclosure;

g. Conduct research on best practices in other LGU's regarding economic enterprise operation and management, including strategies on revenue generation; and

h. Conduct pre-evaluation and assessments on proposals put forward by the members of this team.

Section 6. Fund Support. The FMT shall be provided with the funding support to be taken from 20% Community Development Fund (CDF) or from any available funds deemed appropriate.

Section 7. Repeating Clause. All issuances, memoranda and special orders issued inconsistent herewith are hereby superseded, repealed and amended accordingly.

Section 8. Separability Clause. If any provision of this resolution found to be unconstitutional or inconsistent with any national or local laws, ordinances or resolutions, all the other provisions thereof shall remain in full force and applicable.

Section 9. Effectivity. This Executive Order shall take effect immediately.
