EO 190 - Reorganizing the Cotabato City Joint Transport and Traffic Task Force (JTTTF)

EXECUTIVE ORDER NO. 190
Series of 2017
REORGANIZING THE COTABATO CITY JOINT TRANSPORT AND TRAFFIC TASK FORCE (JTTTF)

WHEREAS, under Section 16 of Republic Act 7160, known as the Local Government Code of 1991, provides that local government units shall exercise the powers expressly granted, as well as the powers necessary, appropriate, or incidental, for efficient and effective governance, and those which are essential for the promotion of the general welfare;

WHEREAS, under Section 454 of said Code expressly empowers the City Mayor to exercise general supervision and control over all programs, projects, services and activities of the city government;

WHEREAS, the same Section of the Code vests upon the City Mayor the power to enforce laws, ordinances, rules and regulations relative to the governance of the city, and issue such Executive Orders for the faithful and appropriate enforcement and execution of the said laws,ordinances, rules and regulations;

WHEREAS, with the growing population, increasing number of transport vehicles, and the fast economic development currently experienced by the City of Cotabato, the need of organizing and constituting an inter-agency task force is indispensable in order to have a specific office which will comprehensively implement and enforce transport and traffic laws, ordinances, rules and regulations in the City;

NOW, THEREFORE, I, ATTY. FRANCES CYNTHIA J. GUIANI-SAYADI, Mayor of the City of Cotabato, by virtue of the powers vested in me by law, do hereby order the following:

Section 1. The “JOINT TRANSPORT AND TRAFFIC TASK FORCE” or hereinafter referred to as the “JTTTF” is hereby reorganized to be composed of:

Section 2. DUTIES AND FUNCTIONS OF THE JTTTF. The JTTTF shall have the following duties and functions: a. Provide technical assistance and support to the City Mayor in carrying out measures to ensure the proper operation of the Joint Transport and Traffic Task Force;

b. Organize and conduct seminars, workshops and trainings for traffic enforcers, drivers of private and public vehicles, and operators of public utility vehicles;

c. Plan and implement traffic education and information campaign thru print and broadcast media; provide brochures and other traffic campaign materials;

d. Ensure the proper and efficient transition of operations and functions of existing transport and traffic enforcement agencies;

e. Undertake steps and operational procedures, as well as perform functions necessary, consistent with the mandates of the : (a) Land Transportation Office (LTO); (b) Land Transportation Franchising and Regulatory Board (LTFRB)); (c) PNP Highway Patrol Group; (d) Traffic Code of Cotabato City, and other city traffic ordinances, rules and regulations; that will pave the way for the effective operation of the task force;

f. Coordinate with the City Permits and Licensing Division in regulating the operations of PUV, tricycle, trisikad, tri-habal (payong-payong), habal-habal;

g. Supervision, direction and control of the City Traffic Enforcers, PNP –TMU, LTO, LTFRB, and HPG transportation and traffic enforcers in the implementation of existing traffic laws, ordinances, rules and regulations;

h. Prepare reports to apprise the City Mayor of the status of the operation of the JTTTF;

i. Perform such other duties as may be required by the City Mayor.

Section 3. FUNDING. The operating expenses of the JTTTF shall be funded from the Office of the City Mayor.

Section 4. SEPARABILITY CLAUSE. If any part or provision of this Executive Order shall be declared bya competent Court invalid, the other portions hereof which are not affected thereby, shall continue in full force and effect.

Section 5. EFFECTIVITY. This Executive Order shall take effect immediately upon its approval and shall remain effective unless amended or revised.
