EO 4 - TRansport and Traffic Management Board

EXECUTIVE ORDER NO. 4
Series of 2010
 

DESIGNATING THE MEMBERS OF THE COTABATO CITY TRANSPORT AND TRAFFIC MANAGEMENT BOARD (TTMB) AND CREATING THE SECRETARIAT THEREOF AND FOR OTHER PURPOSES

WHEREAS, on April 27, 1994, the Sangguniang Panlungsod enacted Ordinance No. 365, otherwise known as "An Ordinance Establishing a Traffic Code of Cotabato City";

WHEREAS, Section 64 of Ordinance No. 365 created the Transport and Traffic Management Board (TTMB) under the Office of the City Mayor to ensure the effective management and control of transport and traffic problems in the city;

NOW THEREFORE, I, JAPAL J. GUIANI, JR. Mayor of the City of Cotabato, by virtue of the powers vested in me, by law, do hereby order the reconstitution of the Cotabato City Transport and Traffic Management Board (TTMB):

SECTION 1. Composition. The Transport and Traffic Management Board (TTMB) whose functions are defined under Section 65 of Ordinance No. 365, otherwise known as "An Ordinance Establishing a Traffic Code of Cotabato City", shall be composed of the following:

Chairman - HON. JAPAL J. GUIANI, JR.
City Mayor

Members - City Administrator

Chief, Traffic Management Unit (TMU) of the Cotabato City Police Office (CCPO)

City Councilor, Chairman of the Committee on Transportation of the Sangguniang Panlungsod

City Councilor, Chairman of the Committee on Police of the Sangguniang Panlungsod

SECTION 2. Functions of the Cotabato City Transport and Traffic Management Board (TTMB). The Board shall have the following functions:

a) Shall prepare measures, policy guidelines, standards and plan of action for the efficient and effective implementation of transport and traffic ordinances, rules and regulations, to improve traffic conditions and situations.

b) Recommend to the Sangguniang Panlungsod (SP) transport and traffic ordinances, amendments to provisions of existing ordinances and resolutions, and even repeal of ordinances and resolutions.

c) Charge with the duty of public information and awareness relative to traffic rules and regulations.

d) Supervise the installation of appropriate traffic signs, parking bay markings, loading and unloading markings and signs, and street markings/ lanes.

e) Supervise, control and monitor all activities related to the implementation of transport policies and ordinances relative to the operations of public utility vehicles ( VANs , PUJs, Tricycles, Trisikads), and operations of terminals and garages;

f) Take action on applications for franchise or renewal of franchise, change of ownership and substitution of engine/unit of existing tricycles and trisikads.

g) Receive complaints against drivers or traffic law enforcers, and act on said complaint with dispatch;

h) Act on request for reconsideration from drivers, operators and traffic law enforcers on the Board's actions before it reaches a competent court;

i) Recommend the organization and maintain a sufficient number of traffic enforcers and aides who will implement and enforce all traffic laws, ordinances, rules and regulations within the city;

j) Coordinate with transport and traffic authorities of other government agencies involved in transport and traffic management and control;

k) To oversee the manner or mode of disposition of funds derived from penalties or fines;

l) Meet regularly to assess traffic situation.

SECTION 3. Secretariat. To assist and provides support in carrying out its functions, the Board shall have a Secretariat to be headed by a Chairman, the functions which shall be hereinafter defined by the Board and in view thereof, the following are hereby designated.

Members: CMO- Licensing Division

Representative from;

Office on Legal Services

City Planning and Development Office

SECTION 4. Function of Secretariat. The Secretariat shall have the following functions;

a) Conduct the systematic recording of all Boards activities and projects, minutes of the meeting and resolutions.

b) To take custody of all records, notes and other records of the Board;

c) To arrange and send notices of meetings and other communications;

d) Exercise supervision and control over all activities and operations related to transport and traffic affairs.

e) Evaluate all Boards project, activities and operations and submit report to the Transport and Traffic Management Board;

f) Coordinate with transport and traffic authorities of other government agencies involved in transportation and traffic management control;

g) Recommend to the City Mayor or Sangguniang Panlungsod, as the case may be, through the Transport and Traffic Management Board, the deputization of additional traffic enforcers and traffic aides as the exigency of the service require.

h) Perform such other duties and functions which the Board and City Mayor may assign from time to time;

SECTION 5. Repealing Clause. All other order, issuances and memoranda issued inconsistent herewith are hereby repealed or modified accordingly.

SECTION 6. Effectivity. This Executive Order shall take effect immediately.
