EO 8 - Task Force on Agri Real Properties

Series of 2010


WHEREAS, a number of owners of agricultural real properties continue to declare their properties as agricultural despite the fact that they have already converted the land to other uses thereby defrauding the government in real property taxes;

WHEREAS, there is also the issue on the continued non-payment of some fishpond operators in the city of their real property taxes despite their being granted by the national government of a Fishpond Lease Agreement (FLA);

WHEREAS, in order to effectively impose the law, there is an urgent need for the creation of a special group to address the issue;

NOW THEREFORE, I, JAPAL J. GUIANI, JR. Mayor of the City of Cotabato, by virtue of the powers vested in me, by law, do hereby order the creation of Task Force on Agricultural Real Properties:

SECTION 1. Composition. The Task Force on Agricultural Real Properties shall be composed of the following:

SECTION 2. Functions. The Task Force shall have the following functions:

a)  Identify all agricultural lands in the city and determine their actual usage.

b) Submit recommendations on legal actions to be taken against owners of agricultural real properties which were converted to other purposes but did not have the approval of the Sangguniang Panlungsod and the Housing and Land Use Regulatory Board (HLURB).

c) Identify fishpond operators who were granted with Fishpond Lease Agreement (FLA) by the national government.

d) In coordination with the City Assessor's Office and the City Treasury Office, serve notice to the FLA holders for the payment of the latter's real property tax dues to the City Government.

e) Prepare and submit documents in support for the filing of legal actions before the appropriate Courts in coordination with the Atty. Rico S. Pelandoc, Assistant City Legal Officer.

SECTION 3. The Task Force shall hold office at the Old City Hall building.

SECTION 4. Repealing Clause. All other order, issuances and memoranda issued inconsistent herewith are hereby repealed or modified accordingly.

SECTION 5. Effectivity. This Executive Order shall take effect immediately.
